VISA Overstay A husband and wife both entered the country on a work visa (H2A), had US Citizen children, and ended up overstaying their visas. They waited 21+ years for their children to be able to petition for them, and Wu Law Firm was able to help them obtain a 10-year green card without a USCIS Interview. They are now able to make a long-awaited trip to their home country of Mexico, visit their family, and come back to the USA.

Cancellation of Removal   “Cancellation of Removal” cases are usually difficult due to the extreme and unusual hardship criteria. In addition, when the client struggles to demonstrate good moral character, the case becomes even more difficult to win. Recently, our office won a case where our client had prior DUI records that affected his good moral character. Our office was able to demonstrate his efforts toward rehabilitation.  As for extremely unusual hardship, we were able to demonstrate at least one child needed special attention because he had suffered infrequent heart murmurs and was missing 1 kidney. In Absentia Deportation       At our Law Firm, we helped a Honduran Single mom, who was ordered an “In Absentia Deportation.” We filed a Motion to Reopen for her and her son at the Newark Immigration Court and the Immigration Judge granted it. We made it to the one-year deadline for them and they were able to apply for their work permits. When she received her permit, she was so happy that she wanted to take a picture with her Attorney to send it to her family in Honduras. We are still fighting her Asylum case in court, and hopefully, we will have a good outcome.
