Temporary Stay

Deportation Defense, Family Immigration
Temporary Stay A young woman with a daughter from Ecuador, had an order of removal and appeal denied. ICE wanted plane tickets to depart. Through the use of a background check, Wu Law Firm was able to pull records of a previous domestic violence incident between her and her ex-boyfriend, submit an emergency request to the Police Department, and follow up to get a U-Visa Certification signed. Due to our efforts, we have been able to convince ICE to issue her a temporary stay to continue living in the US with her daughter.     *The image above is being used for illustrative purposes only; and any persons depicted in the above image are models.

VISA Overstay A husband and wife both entered the country on a work visa (H2A), had US Citizen children, and ended up overstaying their visas. They waited 21+ years for their children to be able to petition for them, and Wu Law Firm was able to help them obtain a 10-year green card without a USCIS Interview. They are now able to make a long-awaited trip to their home country of Mexico, visit their family, and come back to the USA.

Special Immigrant Juvenile – (SIJ) Our Law Firm has a special goal of helping minors adjust their legal status in the United States, for which we use the Special Immigrant Juvenile – I360 Application (SIJ). To get an approved SIJ, the parent or guardian of the minor must obtain full Custody by a Family Court in the U.S., on the basis of abandonment or neglect of the child by one or both parents. At the Wu Law Firm, we are proud to have helped multiple parents obtain SIJ custody and terminate deportation proceedings for their children. One of the most recent successes is the case of a single Mexican mother with two kids. We helped her obtain full custody of her two kids in a New Jersey Family Court, after…

Cancellation of Removal   “Cancellation of Removal” cases are usually difficult due to the extreme and unusual hardship criteria. In addition, when the client struggles to demonstrate good moral character, the case becomes even more difficult to win. Recently, our office won a case where our client had prior DUI records that affected his good moral character. Our office was able to demonstrate his efforts toward rehabilitation.  As for extremely unusual hardship, we were able to demonstrate at least one child needed special attention because he had suffered infrequent heart murmurs and was missing 1 kidney. Winning cases of this kind is meaningful because this is a clear example of the reunification of a family.  It is always a heart-warming experience to see the excitement and happiness of a family…

In Absentia Deportation       At our Law Firm, we helped a Honduran Single mom, who was ordered an “In Absentia Deportation.” We filed a Motion to Reopen for her and her son at the Newark Immigration Court and the Immigration Judge granted it. We made it to the one-year deadline for them and they were able to apply for their work permits. When she received her permit, she was so happy that she wanted to take a picture with her Attorney to send it to her family in Honduras. We are still fighting her Asylum case in court, and hopefully, we will have a good outcome.

In Line for a Green Card! Our firm was able to obtain a grant of Cancellation of Removal in Immigration Court for a woman who had 2 minor USC children and her husband with a green card. They have been present in the United States since 1998. Her LPR husband had ongoing cardiovascular issues. Even though he went back to the Dominican Republic for medical treatment, we were able to prove the exceptional hardship that would befall her family was not due to the lack of medical resources in the Dominican Republic, but rather, the extensive ties her family has here in the United States, and the severe disruption it would cause her family if she were separated from them here, including a business they managed here in US. She is now…
